Denied kidney transplant because of mental problem. Need a lawyer please.?
Hi, My brother has schizophrenia and in kidney failure for 3 years now. Doctors have refused to put him on kidney transplant list saying. He will not take care of his new kidney.For reasons that he walks out of treatment at times and refuses to be treated. He also has seizures, which makes him confused. Just the other day he had several while at hospital and got up and walked out of the hospital. They just allowed him to, he fell out in the lobby. throwing up blood and all. They only talked about him being hard to deal with. I say to them he is confused seizures do that to you. dum a people. Anyway, this is out of control I need help getting him on that list. And seek damages to for my families mental distress of knowing my brother will soon die because they are refusing to add him to list. I am sure that he will die sooner than if given this chance of a new kidney. Who knows if given a new kidney he may live a long normal life. Any Lawyers reading this and willing to take on a lawsuit please contact my family. We live in Arkansas, the hospital treating him at this time is Jefferson Regional Medical Center. I feel like this is how hitler got rid of the poor people, kill off the weaker. Let the stronger live, I thought all men are suppose to be equal and have equal rights here in the USA. So that would mean he has right to be on that list.

You have no case.
Transplant organs are not that abundant, the waiting list is LONG, and finding one to MATCH your brother it’s even harder so doctors really have to choose those who has the best chances to survive.
What can you do?
You can donate one of your own kidneys. You are on the waiting list when you wait for a donor. But organs donated by relatives or friends for an specific person don’t fall under the waiting list rules.
So ask to be tested to see if you are a match (being a sibling it’s almost a sure thing you’ll be a good match; many people donate one of their kidneys and they have no health problems due to that).
Best chance is to look through the phone book for medical lawyers.
Sounds like they made a sound decision.
People in ESRD live for years SO LONG AS they follow the treatment plan religiously to include, diet, fluid restriction and dialysis if necessary.
Without being mean, they are right to not put your brother on the list. He has shown that he is non compliant.
Your comparison of this to Hitler and the Holocaust merely shows your complete and total ignorance.
His place on that list is not a right, there are many people out there who are alcoholics that are not on the list, that have other health problems aside from the renal failure that are not on the list.
If he is diagnosed with mental diseases then he SHOULD be on meds. You make it sound like he either isn’t or isn’t taking them. He is being denied not to kill off the weak, but because there is no point. Do you think that a drunk should be allowed to get a liver transplant? Is it fair that they have to stay sober? Sorry but from the sounds of it the doctors are RIGHT to not but him on the list.
UNfortunateky due to the scarcity of organs, not every patient is quaranteed a place on the list. In order for a patient to be a candidate they have to be in otherwise great health and show the ability to care for themselves, including a new regiment of drugs, specialized diet and attend regular appointments.
Your brother due to his illness has shown and inability to care for himself. It is extremely unfortunate, however being put on a transfer list isn’t a right, it is an option only available to a few.
You can see if you can do a family match or private living donation to circumvent the list, however that may be your only option.
Are there any members of the family who might be able to donate a kidney? That may be your only recourse.
The supply of donated organs is very limited, and they need to be placed with people who will comply with all aspects of treatment, and who have the best chance of making them work. I have a good friend who needs a kidney and has been on the list for 9 years. She’s getting daily dialysis, but who knows if a kidney will ever be available for her. Another needs a heart, but he’s Type 1 diabetic and he won’t be getting one. Drug addicts and alcoholics can’t get organs. There are very strict criteria for good reasons.
Due to the shortage of available organs the waiting list for any organ is sky high. Many people on those lists die before they can get one. Due to that the rules of getting on a list is very strict. Age, history of suicide, mental illness, terminal illnesses, history of drug abuse, etc rule people out for getting on the list. When you only get a handful of organs and have thousands of recipients you need to decide who will most likely live a long life with it.
Seeing that your brother does have a mental illness and is not always compliant with his medication he will not be able to get on the list. After an organ transplant you need to take antirejection medication for life. Seeing that he cant take care of his current condition he will most likely be unable to take the correct medication to prevent his body from rejecting the new liver.
I understand how unfair this does sound, but that is just how it is. You may be able to find an organization that will transplant not so qualified organs, such as organs with infection that he would have to take antibiotics with the transplant to clear them up. I do not know if they exsist, but it is worth a try to look.

You are talking about an enormously expensive lawsuit. Unless you are fabulously weathy, this is not a case you can afford and it is not a case that a lawyer will take for free. It also has very little chance of succeeding.

The case of your brother is really difficult to handle since doctors know that whenever they put a kidney on your brother there is no guarantee that he would take care of it. Why not hire first a psychiatrist for him, and that maybe can help to slow down his mental illness. It is really difficult for the doctors to let kidney transplant since it is not safe for him because of his mental condition. If then when your brother is mentally fit and the doctors will not let kidney transplant that’s the time that you will hire a lawyer to put him on the list.

Before you worry about a lawyer get him out of that hospital. He needs to be someplace where they are accustomed to dealing with mental patients. At the very least let the staff know of his condition and request a specialist.
