Can this hopsital really get away with this!?
my husband went in several months ago to the ER (he was in extreme pain)for a colon issue and got a cat scan. They found no problems with his digestive system or anything in the cat scan..they told him he should see a gastroenterologist . So he did a few mths later (after insurance had kicked in) and the results oft the cat scan were faxed to the gastroenterologist(sp?) and they told my husband that the cat scan showed that he had kidney stones…
The hospital said NOTHING about kidney stones!! Isn’t it there job to tell him if something was wrong!?!
Someone said that because thats not what he went in for that they didnt HAVE to tell him about it…
The gastroenterologist said the kidney stones shouldn’t get any worse if my hubby changes his diet. so they aren’t an immediate threat. But he could have been working on fixing it MONTHS ago!!
Am I wrong…but I think they should have told him!! Can I get them in trouble for that!?! lol

While I see your point of view, I know that unless there was urgency associated with the presence of the stones, the ER doctor was not legally or even medically obligated to discuss it with your husband if the stones were not producing the symptoms being addressed in the ER.
By advising your husband to seek medical care, the assumption is that the CAT scan results would be forwarded to the doctor of your husband’s choice, who would then make the call on how to deal with the kidney stones. The symptoms that prompted your husband’s emergency room visit apparently had nothing to do with the kidney stones, and therefore the stones were not the priority of the emergency dept staff.
I agree, though, that it would have been nice had they mentioned the stones and included advice to follow up on that, but not telling you doesn’t constitute malpractice, and as I said, the gastroenterologist your husband was advised to see would have dealt with you on that.
So the fact that your husband waited months to follow the advice given by the ER doctor and see a gastroenterologist as he waited for insurance to kick in, was your husband’s choice, and that choice did go against the medical advice he received in the ER. To now complain that he could have been doing something about the stones for all these months only points to the fact that he should have followed the medical advice he was given by the ER doctor.
Well not really, that just reflects that the people who told you the results were being jerks.

SOunds like a misdiagnoses. My husband had a broken back and they didn’t see it. How can you not see that??? CAll the hospital administrator and complain, Also tell them you are not paying the bill!!
YES!!!!! It depends tho is he ill from this?? If he is then I suggest you call your local state legal aid.
i agree with you, they should have told him what was wrong even if its not what he went in for, but sadly, you cant get them in trouble for it.
Unfortunaltely, most hospitals do what ever they want to, most do not get into trouble,
Our healthcare system in America is incredibly corrupt. Like the Medieval/Pre-Reformation Catholic Church, it’s run more as a business than a means by which to help people. I’d venture to say the hospital can buy or argue their way out of this, but if you have the money, it wouldn’t hurt to call them out on this with state or national jurisdiction as your audience. Maybe you had a crappy doctor and the hospital is just looking for a reason to get rid of them; it’s more likely that you just have a crappy hospital, as are most.
This is why if I had any say, national healthcare would be my vote. Europeans don’t have to go through trouble like this.
But to answer your question directly, yes, they could easily get away with this. They do it all the time. It’s a business. But if you have a spinal cord, grab yourself a good lawyer and give them hell.

Remember that the hospital probably had a radiological tech checking the CT Scan for colon issues only…however, it is irresponsible to have not checked the entire abdomen for ALL possible signs that something was wrong. It sucks how many irresponsible people there are in health care. Unfortunately, the hospital will just sweep this under the rug…especially since kidney stones aren’t life threatening.
What concerns me is the fact that the Gastrointerologist didn’t send your husband to a Urologist when they discovered the kidney stones on the CT scan! Good grief! It’s just a sesession of crappy health care. Yes, your husband needs to change his diet, BUT he needs to have a Urologist look at that CT scan…those kidney stones will HAVE to pass (and that is more painful than natural child birth), so he’ll need to have their size evaluated. Are they small enough to pass on their own? Has anyone prescribed him pain meds for when they do begin to pass? Make an appointment for him with a Urologist…please.
I would ask the gastroenterologist whether it is possible that your husband could have started passing the kidney stones, if his answer is yes then the hospital certainly do have a case to answer.without going into a lot of detail passing kidney stones in men can do a lot of internal damage.
I think you are right to feel that the hospital should have revealed all perhaps a letter to the hospital administrator in the first instance, may get a explanation of their policy. I have found that often this will instigate an internal investigation,as to why all was not revealed.
If you still feel dissatisfied by their reply I would then take legal advice and go from there
